Aloha Mr. Yogi,

Pursuant to the Uniform Information Practices Act (Modified), Chapter 92F, Hawaii Revised Statutes (“UIPA”), the Part 135 Regulated Operator’s Partnership of Hawaii (PROP) hereby requests access to certain government documents believed to be in the custody of your agency including, but not limited to:

    • Any and all documents, applications, financial statements, forms or other materials submitted to the Hawaii Department of Transportation Airports Division by any airline companies seeking signatory carrier status within the past 10 years; including documents indicating date(s) of submission, approval or declination

    • Any audits, reviews, findings or other assessments of continuing financial suitability for signatory carrier status for any airline companies, conducted by the department at any time after September 11, 2001

    • Any audits, reviews, findings or other assessments of continuing financial suitability for signatory carrier status conducted by the department at any time after September 11, 2001 for the following air carriers:

      • Hawaiian Airlines
      • United Airlines
      • American Airlines
      • Delta Airlines
    • Any and all documents, invoices, ledgers, books, statements, account histories, letters, memoranda or other materials detailing any fees, rents, or other unpaid debts owed to the Hawaii Department of Transportation for more than 90 days by any of the following air carriers since September 11, 2001:

      • Hawaiian Airlines
      • United Airlines
      • American Airlines
      • Delta Airlines

    • Any and all procedures, rules, criteria, standards, guidelines, memoranda or other materials used by Hawaii Department of Transportation Airports Division personnel to evaluate, assess, judge, approve or reject air carrier applications for signatory status.

    This request encompasses any and all pertinent materials maintained by the department in written or electronic form. These materials are being requested in order to raise media, legislative and regulatory consciousness regarding matters of public interest involving the administration and management of Hawaii’s publicly financed airports.  It is our belief that release of these records will serve the public interest, and we request that all fees for searching, reviewing, or segregating disclosable records be waived, pursuant to H.R.S. §92F-42.

    If you anticipate that it will take the department longer than 10 business days to process this request, we ask that you provide us with a written estimate of when these materials will be available for our review.
