Aloha Mr. Kondo,

Attached, please find copies of various government records requests submitted to the Hawaii Department of Transportation (HDOT). These documents clearly identify the scope of each request, and provide specific descriptive information necessary to identify records of interest. Each letter requests contact from HDOT if the agency will be unable to provide records within ten (10) business days.

To date, we have received access to none of the requested records, nor any indication from the agency that requested records do not exist. Moreover, HDOT has made no apparent effort to explain significant delays in its handling of these requests for government records pursuant to the Uniform Information Practices Act (Modified), Chapter 92F, Hawaii Revised Statutes (“UIPA”).

Therefore, pursuant to section §92F-42(1) we are requesting that the Hawaii Office of Information Practices:

  • conduct an inquiry and investigate apparent UIPA compliance violations on the part of HDOT officials, pursuant to §92F-42(4);
  • examine HDOT records in question, pursuant to §92F-42(5);
  • review the official acts of HDOT appointees and staff relative to UIPA requests made by Pacific Wings pursuant to §92F-42(9);
  • review and rule on HDOT’s denial of access to information and records, pursuant to  §92F-42(1);
  • provide an advisory opinion regarding the rights of interested members of the public to access and inspect documents requested pursuant to the UIPA, and the responsibilities and functions of HDOT within the context of that request, pursuant to §92F-42(3);
  • provide assistance in obtaining access to requested documents; and
  • recommend disciplinary action for HDOT appointees or staff found to be in violation of the UIPA, pursuant to §92F-42(6).
Mr. Kondo, we appreciate your diligent interest in these matters, and look forward to prompt access to requested government records.
