Pursuant to the Uniform Information Practices Act (Modified), Chapter 92F, Hawaii Revised Statutes (“UIPA”), the Part 135 Regulated Operator’s Partnership of Hawaii (PROP) hereby requests access to certain government documents believed to be in the custody of your agency.
Documents of interest include, but may not be limited to any and all letters, memoranda, emails or other written or electronic communications by any Airports Division employee or appointee to any federal official or agency:
- concerning or on behalf of Island Air;
- in support of any federal request, application, approval, waiver, variance, dispensation, authority or permission sought by Island Air;
- concerning the continued presence of TSA security personnel at Lanai and Molokai airports after Hawaiian Airlines ceased operating large jet aircraft there
- for the purpose of assisting or facilitating efforts by Island Air to obtain waivers, variances, dispensations or other relief from any federal requirement to provide its own security at Lanai, Molokai, Kapalua and/or Kahului Airport Commuter Terminals;
or,
- in support of any proposal, effort, arrangement or initiative that would serve to shift the cost of airport security screening from airlines to federal taxpayers, under circumstances where the airlines would otherwise be required to bear these costs (such as Dash-8 operations at Lanai, Molokai, Kapalua and the Kahului Airport Commuter Terminal).
This request encompasses any and all pertinent materials maintained by the department in written or electronic form. These materials are being requested in order to raise media, legislative and regulatory consciousness regarding matters of public interest involving the administration and management of Hawaii’s airports.
It is our belief that release of these records will serve the public interest, and we request that all fees for searching, reviewing, or segregating disclosable records be waived, pursuant to H.R.S. §92F-42.
If you anticipate that it will take the department longer than 10 business days to accommodate this request, we ask that you provide us with a written estimate of when these materials will be available for our review.
